How is bail set?
Bail is the amount of money one must pay to the court in order to be released from police custody between the time of arrest and the trial date. This payment will be returned to the offender if and when he or she appears in court. Bail amounts vary from case to case. They are dependent upon certain factors that are unique to each situation:
- Severity of the crime
- Amount of harm done to other people
- Offender’s criminal record
- Current financial and family situation of the offender
- How much threat the offender poses to the rest of the community
