Appeals court considers DUI blood drawing decision

Posted on April 20th, 2011 No Comments

A Florida Appeals Court in Daytona Beach is currently considering an appeal which calls to question whether or not Florida law enforcement can forcibly draw blood from individuals suspected of driving under the influence.  The court’s decision will affect 13 counties in Central Florida and could influence rulings throughout the state.

The appeal concerns a Rockledge man who was pulled over by a Melbourne police officer in September 2009 after the officer witnessed him moving between lanes on U.S. 1.  A county judge signed a warrant to take a blood test from the man.  When the man went to court, the blood sample was not permitted as evidence, leading the state to file the appeal.

The court did not allow use of the blood sample because it felt that it could not be considered “searchable property.”  The state is challenging this and what should be applied to its implied consent statute.

Boca Raton police recently arrested two men after they had to stop them from fighting over a drug deal.  Police were conducting a controlled drug purchase on Tuesday evening on NW 4th Avenue.  After entering the apartment where the sale was to take place, police found the dealer choking the buyer.

Officers separated the two and, according to police reports, found evidence of drug manufacturing and selling in the apartment.  Evidence included drugs like marijuana, LSD, Xanax, and Ecstasy, and drug paraphernalia.  After securing a search warrant, officers found equipment and chemicals used in drug manufacturing.  The buyer’s roommate was also arrested and charged with possession of drugs and drug paraphernalia.

South Florida man arrested for “kava tea” DUI

A Boyton Beach man recently had a DUI charge made against him dismissed.  46-year old Napoleon Samuels was arrested by police last year when police found him nearly passed out in his vehicle, which was partially sitting on top of a sidewalk.  Police reports state that Samuels was unable to stand steady, was sweating heavily, and was on the verge of falling asleep.  In addition, he is said to have failed several field sobriety tests.

When police officers administered a breathalyzer test, they were unable to find signs of alcohol in Samuels’s system.  Samuels told officers that all he had had to drink was a couple cups of kava tea.  The substance is legal, but police arrested him anyways.  Kava is most often consumed to relieve anxiety and insomnia.  Samuels’s license was suspended after the arrest and he was later arrested and placed in jail for several months for violating probation.

City to install citywide surveillance camera system

Posted on March 30th, 2011 No Comments

City officials announced earlier this month that a citywide surveillance camera system will soon be put in place in Boca Raton.  The first phase of the project is underway and is estimated to cost around $1 million.

The surveillance cameras will be used primarily to monitor and record suspicious or criminal activity, not traffic offenses.  The closed circuit cameras are being installed outside several public city buildings, parks, and along roadways.

“The intent is to tie all those existing systems together within the next year and then add to that system where it makes sense…It’s important to recognize that we are moving into an era of intelligence-led police,” said Boca Raton Police Chief Dan Alexander.
