Florida laws relating to boating under the influence include the following:
- Operating a boat with a blood alcohol level of .08% or higher is punishable by a fine of up to $500 and imprisonment for up to 6 months.
- A second conviction is punishable by a fine of up to $1000 and imprisonment for up to 9 months.
- A third conviction within ten years of a prior conviction results in a third-degree felony.
- Anyone operating a boat while intoxicated who causes damage to another person’s property commits a first-degree misdemeanor.
- Anyone operating a boat while intoxicated who seriously injures another person commits a third-degree felony.
