Felony DUI
Driving under the influence (DUI) or driving while intoxicated (DWI) is typically considered to be a misdemeanor offense. If you are caught driving with a blood alcohol content (BAC) level above the legal limit of 0.08, then you will be charged with DUI. All first and second offenses are misdemeanors, punishable by up to one year in prison and a fine of up to $2000.
Third-time offenses within a 10 year time period and all subsequent DWI citations, however, are taken much more seriously. They will be charged as felony DUI, which is a third degree felony. DUI that results in serious bodily injury to another individual is also charged as a third degree felony.
The Punishment for Felony DWI
Felony DUI may be punished much more severely than misdemeanor drunk driving offenses. Those convicted of this crime will face the following penalties:
- A fine of at least $2,000 and up to $5000
- Up to 5 years of incarceration
- Impoundment of personal vehicle

DUI / Manslaughter
If you are driving under the influence and cause death to another person, then you may be charged with DUI/manslaughter, which is a second degree felony. You will face a jail sentence of up to 15 years and a fine of up to $10,000.
Should you leave the scene of the crime without giving aid to the harmed victims, you will also be charged with leaving the scene. This combination of DUI/manslaughter and leaving the scene is punishable as a first degree felony. You will face up to 30 years in jail and a fine of up to $10,000.
